1. Acceptance

By installing or using the Terminal Commerce Channel application ("the App") on your Shopify store, you ("Merchant") agree to these Terms of Service. If you do not agree, do not install or use the App.

2. The service

The App lets a Merchant expose an approved subset of their Shopify catalog to AI assistants and Model Context Protocol (MCP) clients, which can search products and prepare a Shopify-hosted checkout. The App does not process payments: every purchase completes through Shopify checkout, and a human buyer must confirm before checkout proceeds.

3. Beta status

The App is provided as a free design-partner beta. Features may change, and the service is provided "as is" without uptime guarantees. If paid plans launch, they will run through Shopify-managed billing and no charge will occur without your explicit approval.

5. Acceptable use

You may not use the App to violate any law, infringe third-party rights, transmit malicious code, attempt to access data you are not authorized to access, or abuse, overload, or reverse-engineer the service. Product content you expose through the channel is treated as untrusted input by connected agents.

6. Data & privacy

Our handling of merchant and store data is described in the Privacy Policy, which is incorporated into these Terms. The App does not collect or store customer PII or payment data.

7. Intellectual property

The App, including its software and brand, is owned by the Provider. These Terms grant you a limited, non-exclusive, non-transferable right to use the App while installed. Your store data remains yours.

8. Disclaimers & limitation of liability

The App is provided "as is" and "as available", without warranties of any kind, express or implied. To the maximum extent permitted by law, the Provider is not liable for any indirect, incidental, special, or consequential damages, or for lost profits or revenue, arising from your use of the App. The Provider's total liability is limited to the amount you paid for the App in the twelve months preceding the claim (which, during the free beta, is zero).

9. Termination

You may stop using the App and uninstall it at any time. On uninstall, all per-shop data is deleted as described in the Privacy Policy. We may suspend or terminate access for violation of these Terms or to comply with law.

10. Changes

We may update these Terms; material changes will be posted here with an updated effective date. Continued use after changes constitutes acceptance.

11. Governing law

These Terms are governed by the laws of the Province of Québec and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles.
